Since 2006, FOE has challenged Canada in the courts on lack of action on climate change. It’s a long and winding road through the federal courts.
FOE expects to hear anyday now whether the Supreme Court of Canada will hear its appeal on Canada’s refusal to respect the federal law that requires reduction in greenhouse gas emissions, the Kyoto Protocol Implementation Act. The case has evolved into addressing the fundamental question of whether the government is above the law. “If the government is allowed to continue its clear disregard of the KPIA, it can do the same thing with future laws whether on climate change or other fundamental matters,” says Chris Paliare of Paliare Roland Barristers acting for FOE.
On March 25, 2010, the Supreme Court of Canada dismissed FOE’s application to appeal its KPIA case. FOE will disclose its plan for next steps once we have reviewed our alternatives. Read CEO's Statement
